I'm curious, do you know how fandom RP works? The original poster was not trying to be you in any way, fashion, or form. They aren't making any money. They just happen to like your character enough to produce fandom works. That's pretty flattering, and as a writer trying to get published, I can't wait until my writing gathers enough interest for someone to roleplay as one of my characters on an obscure website. That means you're in good company. People here rp from the works of Tolkien, GRR Martin, and even some classic literature like Victor Hugo.

Also, I hope you realize it seems a bit disingenuous of you to be so harsh on "copywrite infringement" when it appears your work is a parody of a ballet you only have the right to parody due to being in the public domain.

They're not claiming ownership, they're not making money, they're not claiming to be you - what the heck? I'm pretty damn sure this falls under Fair Use, especially since your work is an interpretation of something else anyway.

So, basically - what court would take this case? Are you twelve? Because the last time I saw someone threatening to sue someone else like this, it was fanfiction writers getting mad at Pottersues.

this is no way EVER to react to someone in your fanbase. they aren't claiming the slutcracker as their own. they aren't claiming the images as their own. it's a roleplay account, plain and simple.

I think you just missed the entire point of Dreamwidth RP. First off, with the exception of original characters, no one is claiming to own any character or story they roleplay the characters from. It's meant to be a fun hobby. Even ignoring the fact that your work is a burlesque comedy protected under the same law as RPing a character, this isn't hurting your work. Instead, it makes people curious about it and might instead help you by making people want to go see your work. Or it would if you didn't just make an ass of yourself.

Congratulations, you might be one of the few creators crazier than Anne Rice.

Wow, just... wow.

If you seriously think you could take an RP account to court and win against a Fair Use defense, you need to step back and re-evaluate what your idea of infringement is. I have a feeling a judge would certainly take into account that your work is in of itself a derivative of someone else's, too.

I'll not even get into the fact that as a creator you're supposed to appreciate your fans, not treat them like garbage. That doesn't mean bullying someone into deleting their account with threats of lawyers that, realistically, would scoff at a case like this, because unlike you, they'd know better.

Kick over a basket of puppies while you're at it, I doubt that can do much more damage to your PR than a stunt like this does.

You know, the sad thing is that I love the Nutcracker. I've performed it more than once and I've been interested in its parodies and spin-offs, so to speak, like the Slutcracker.

And now you've killed any desire I have to see it.

Honestly? I would see someone RPing one of your characters as a badge of honor. It means they like your work in some aspect and are raising awareness of it. Even if you don't like it, it's still protected under Fair Use.

Honestly, if you'd just said you were uncomfortable and would prefer this RPer stop using the account, I'd figure, OK: you're uptight, probably getting rid of some valuable exposure to people who haven't seen your show, but still perfectly within your right to request they stop.

But you didn't. You said this was infringement, when the RPer is perfectly within their right -- everyone else has mentioned Fair Use, and I'd also like to stress what others have said about your work being a parody of a ballet that was based on a book. So not only did you get rid of the exposure to potential fans, you also lied.

Unless you already have a lawyer lined up and ready to tackle this specific issue (which you might! and that poor lawyer is not going to have a very strong case), you're bluffing.

You, madame, are really very rude, do you know that? For instance, all you had to do was PM the person and politely ask them to not rp from your parody work. And, assuming that you do not know how to PM, you could have still posted a polite request saying "Eh, I'd rather you not." You didn't.

(PS: In case you don't know, it's as easy as hovering over the name and clicking 'Send Message.')

My second problem is with your rudeness, but also with those who so voraciously decry fan works. Fan works are a form of free advertisement, word of mouth, a way to gather interests and--oh wait, there's a benefit to the fan, too--make friends. By saying that you do not wish fan works to be made of your work (which you are well within your rights to do, no matter how unwise it may be), you are removing any possible free advertising, any way for others to garner interest in your works for free, and any expression of appreciation of your characters. You are not just hindering your fans' creativity (trust me, they'll move on), but your own possible profit.

Speaking of profit, you are only in for the almighty dollar, aren't you? See, I know (personally know) authors who encourage roleplay and fanfiction, even to the point of making themselves available to answer questions from the fans, no matter how trivial the question may be. You, madame, are certainly not interested in your fans. You don't care about whether people like your work, nor if they spread the word, only that they pay for it.

Imagine if E. T. A. Hoffman acted (or had representatives to act, as he is dead) as you do. You would not have had the freedom to make your little parody. You would, as it stands, be in jail for plagiarism.

The tl;dr of it is good job alienating possible fans and a good chunk of the online community. You can be absolutely sure that people will hear about this. Your audiences will suffer. Your wallet will suffer.

Long story short, you were rude and screwed yourself.

If your original post was not rude, then this comment certainly is. No one said you did not have the right to defend your intellectual property. We just don't like the way you're choosing to do it. As the person above said, a quick private message would have sufficed. And part of the reason we don't understand your position is because of the amount of misinterpretation involved on your end.

Nobody is claiming to own your work. Nobody is trying to profit monetarily off of it. Fan activities like this one amounts to children playing with dolls. Would it be good etiquette for the makers of GI Joe to tell children "you and your friends can't make up stories for these characters while playing with their action figures because these are my creative property"? Roleplay is play and the stories we make up around these characters we use for it are ultimately just fun stories not meant to infringe on a creator's "legal entities and intellectual properties."
